Feasty Terms & Conditions

1. Introduction

Welcome to Feasty ("Feasty," "we," "our," or "us"). These Terms & Conditions ("Terms") govern your access to and use of the Feasty mobile application, website, and related services (collectively, the "Platform").

By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use Feasty.

2. Marketplace Role

• Feasty provides a technology platform connecting customers ("Customers") with independent food truck operators and mobile food vendors ("Vendors").
• Feasty does not own or operate food trucks, prepare food, or guarantee Vendor compliance with health, safety, or licensing laws.
• Vendors are solely responsible for their operations, including food preparation, pricing, and service quality.
• Customers purchase directly from Vendors, not Feasty.

3. Eligibility

• Customers must be at least 18 years old.
• Vendors must be legally registered food businesses and maintain permits, licenses, and insurance as required by law.

4. Accounts

• You must provide accurate account information.
• You are responsible for maintaining the confidentiality of your account and password.
• We may suspend or terminate accounts that violate these Terms.

5. Payments & Fees

• Orders are processed through Stripe Connect Standard. Feasty is not the merchant of record.
• Customers agree to pay the total order price, including vendor charges, applicable taxes, and a 3.5% platform convenience fee.

6. Vendor Responsibilities

• Vendors must comply with food safety, tax, and business laws.
• Vendors are responsible for accurate menus, pricing, and timely service.
• Vendors agree not to misuse the Platform for unlawful purposes.
• Vendors are expected to indemnify Feasty for claims relating to their food, services, or conduct, but enforceability may depend on acceptance of separate Vendor Agreements.

7. Customer Responsibilities

• Customers must provide accurate order and contact information.
• Customers are responsible for inspecting food at pickup/delivery.
• Customers should contact Vendors directly with issues.
• Feasty disclaims liability for allergen exposure and reminds Customers to ask Vendors before ordering.

8. Cancellations & Refunds

• Vendors set their own cancellation and refund policies.
• Feasty does not issue refunds on behalf of Vendors.
• Feasty's 3.5% platform convenience fee is non-refundable in all cases, regardless of the reason for cancellation or refund.
• Payments remain subject to Stripe's processes and rules.

9. Catering & Events

• Vendors may accept catering or event requests through the Platform.
• Feasty does not guarantee Vendor availability for catering bookings.
• All catering bookings are processed and paid through the Platform. A 5% processing fee applies to all catering orders and is non-refundable under all circumstances.
• In the event of a Vendor no-show or cancellation of a confirmed catering booking, refund eligibility of the Vendor's portion is subject to the Vendor's cancellation policy. The 5% processing fee will not be refunded.
• Contracts or additional terms for catering services are solely between Customers and Vendors. Feasty is not a party to such agreements.

10. Fees

• Customers pay a 3.5% platform convenience fee per order, which is non-refundable under all circumstances.
• Vendor fee structures are governed by the applicable Vendor Agreement between Feasty and each Vendor.
• Feasty reserves the right to modify its fee structure upon notice provided through the Platform or by email.

11. Liability Disclaimer

• Feasty provides the Platform "as is" without warranties of any kind.
• To the maximum extent permitted by law, Feasty is not liable for indirect, incidental, special, or consequential damages.
• Our total liability to you is limited to the greater of (a) the fees you paid Feasty in the last 6 months or (b) $50.
• Nothing in these Terms limits liability for gross negligence, willful misconduct, or personal injury where such limitation is prohibited by law.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and the parties hereby consent to personal jurisdiction and venue in such courts.

• Where permitted by applicable law, disputes may be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or in small claims court for qualifying matters.
• By agreeing to these Terms, you waive the right to participate in a class action lawsuit or class-wide arbitration.
• Nothing in these Terms prevents you from exercising rights available under applicable consumer protection laws.

13. Privacy

Your use of Feasty is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Platform, you acknowledge and agree to our Privacy Policy.

14. Changes to Terms

We may update these Terms at any time by posting a revised version on the Platform. Your continued use of the Platform after any such changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Termination

Feasty may suspend or terminate your account or access to the Platform at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent, abusive, or unlawful activity, or for any other reason at our sole discretion. Feasty also reserves the right to remove any content, listings, or features at its discretion.

You may stop using the Platform at any time. Any rights, obligations, or liabilities that accrued before termination—including payment obligations, non-refundable fees, and dispute resolution provisions—will survive termination.
